America’s mindless madness is the ongoing public policy delusion that America and anarchy are compatible.
We define ‘mindless’ as careless, senseless, or inhumane and ‘mindful’ as careful, sensible, or humane.
Why ‘Mindless madness’? It is a necessary new term to name and explain the many unprecedented, out-of-control, existential, problems, dynamics, and effects, that:
- Result from U.S. Wild West Internet policy of approved anarchy on autopilot, and
- Endanger, dehumanize, and disrupt Americans and America with impunity.
Our foe is outdated, anarchic Internet policy, not government, technology, or business.
WHAT COMPRISES MINDLESS MADNESS?
Approved Anarchy
1. It is U.S. policy-approved anarchy on autopilot.
Mindless madness is the comprehensive chaos consciously caused by 1990’s U.S. Wild West Internet policies of approved anarchy on autopilot that are continuously compounded by the national neglect of five Administrations, thirteen Congresses, and 17 Supreme Court Justices. Together they have neglected to protect the American people from harms and crimes online since 1996.
Constitution Subversion
2. It is U.S. policy that is subverting the purposes of our U.S. Constitution.
Mindless madness is what happens when universal U.S. Internet policies’ anarchic purpose is antithetical and hostile to all the purposes of the U.S. Constitution. Online, it effectively abdicates governing; divides union; disestablishes justice; incites domestic chaos; neglects homeland security; subverts the general welfare; and takes away our rights and liberty to live freely.
Dehumanization
3. It is U.S. policy that dehumanizes by harming humanity online.
Mindless madness is when government regresses to value technology over humanity and profit over people in official universal public policy. U.S. Internet policy perversely prevents protection of people to protect technological efficiency and corporate profits from actions by people and government. Thus, people have become dehumanized virtual chattel, and disenfranchised, data-indebted, indentured Americans. Minors are defenseless prey.
U.S. Internet users are data products, commercial chattel bought and sold with impunity by data brokers, without meaningful consent, rights, rule-of-law, protections, privacy, or security.
They also are indentured Americans online abandoned by their government, to become disenfranchised commercial captives of one-sided legal terms and indentures. Thus, they do not control their own virtual value, identity, humanity, security, privacy, or destiny.
Minors are virtual defenseless prey fed to online predators, and minimally protected as lab rats to test, addict, and depress, and lambs to abuse and traffic with impunity.
Rejection of Morality & Ethics
4. It is U.S. policy that rejects religious morals and secular ethics online.
Mindless madness is amoral U.S. Internet anarchy policy that rejects all standards of authority, conduct, good over evil, and right over wrong. That means online U.S. Government policy no longer promotes the Golden Rule/Ethic of Reciprocity – ‘treating others as you want to be treated’ – a rule found in some form in every major religion and secular ethical tradition. Instead, online it promotes a de facto ‘Rotten Rule’ of ‘do whatever you want to others,’ which robs people of their humanity.
The Jewish and Christian faiths embrace the Golden Rule, as do most religions. For example:
Judaism — “You shall treat the stranger who sojourns with you as the native among you, and you shall love him as yourself, for you were strangers in the land of Egypt: I am the Lord your God.” Leviticus 19:34.
Christianity — “So, whatever you wish that others would do to you, do also to them, for this is the Law and the Prophets.” Matt.7:12.
Shared Jewish/Christian scriptures tellingly warn against government descent into anarchy.
“Woe to those who call evil good and good evil, who put darkness for light and light for darkness, who put bitter for sweet and sweet for bitter!” Isaiah 5:20.
“Woe to those who decree iniquitous decrees, and the writers who keep writing oppression, to turn aside the needy from justice and to rob the poor of my people of their right, that widows may be their spoil, and that they may make the fatherless their prey!” Isaiah 10:1-2.
The Bible warns against people not being subject to governing authority and has an answer.
“Do not be overcome by evil but overcome evil with good. Let every person be subject to the governing authorities. For there is no authority except from God, and those that exist have been instituted by God.” Romans 12:21-13:1.
Extreme Experimentation
5. It is an extreme experiment: Does technocracy & corporatocracy outperform democracy?
Mindless madness is U.S. public policy that empowers only Internet technology and firms to operate unfettered and autonomous at people’s risk and expense. This experiment grants technocrats and corporatcrats impunity to govern people like lab rats with one-sided Terms of Service and end user licensing agreements that deny people meaningful consent, rights, rule-of-law, due process, and access to justice.
Polarization & Division
6. It is a diametric double-standard policy causing widespread polarization and division.
Mindless madness is self-sabotaging Internet public policy that imposes a diametric double standard for legal/illegal conduct, i.e., government authority/accountability offline, but ~none online. This naturally incents diametric real vs. artificial selves, realities, and conducts. It also logically promotes divisive extremes i.e., extreme polarization, incitement, hate, bias, discrimination, rage, violence, and monopolization.
Extremism & A Nation Divided
7. It is extreme policy that causes extreme excesses everywhere.
Mindless madness is extreme policy effecting extremism and a nation divided in polarizing people, dividing states, inciting incivility/mobs, trampling truth/trust; and decivilizing America. Commercially, Internet impunity prioritizes profit over people, crony capitalism, a faux market, cheaters charter, liars license, and fraud farm. Banning borders, police, and protections online promotes national-insecurity, public unsafety, cybercrime, cyber-espionage, and terrorism-tolerance.
Regress of Reason
8. It is regressive policy that promotes the regress of reason and truth.
Mindless madness is primitivist policy advocacy that “disruption” is good when it regresses to chaos; “decentralized finance” is democratizing when it regresses to a fraud farm; “crypto” is currency, stable, and safe when it regresses to fraud, market crashes and survival of the richest; “permissionless innovation” is benign, when it regresses to law of the jungle; and “Evasive entrepreneurialism” is not innocent innovation but regress to primitivist, predatory, lawless disorder.
Cyber-Surrender
9. It is policy that surrenders America’s digital sovereignty, borders, and national security.
Mindless madness is U.S. policy that treats the Internet only as an unfettered speech network with absolutist free flow of information, and does not also treat it as the all-purpose, commercial, and criminal, conduct conduit, and weaponized battlefield infrastructure, that it has become. America has surrendered its online sovereignty and borders to foreign countries and bad actors. America isn’t adequately defending its governments, companies, organizations, and people from foreign attack and espionage online. Online, China and Russia disrupt America’s critical functions with impunity.
America’s Worsening
10. It is approved anarchy policy that worsens, not betters, people’s lives and futures.
Mindless madness is how Wild West Internet policy combines together to worsen not better people’s lives, futures, and potentials. Anarchic policy first regresses reason in demoting the need of self-preservation; second it disorders with no authority; third it endangers with no protections; fourth it corrupts with no standards; and fifth it dehumanizes with no rights.
WHAT U.S. POLICIES CAUSE MINDLESS MADNESS?
Legislative Branch – Unfettered by government
1. CONGRESS 1996, Communications Decency Act 230. “It is the policy of the United States… to preserve… the Internet and other interactive computer services… unfettered by Federal or State regulation.”
The practical effect of a no government authority online policy for 25 years on autopilot has been to create an absolutist technocracy where Internet technology firms by default can govern people and conduct commerce with impunity.
This extreme double standard of government authority offline but not online, practically promotes love-your-neighbor and duty of care conduct offline, while promoting the opposite online in practically promoting harm-your-neighbor, impunity-driven, conduct online.
Unfettering Internet technologies and firms from Government in U.S. policy naturally causes commercial corruption and crony capitalism by permanently prioritizing technology over humanity, and profit over people.
Judicial Branch – Free speech absolutism
2. SUPREME COURT June 26, 1997, Reno v ACLU struck down the Communications Decency Act (CDA) 9-0 for abridging adults’ constitutionally-protected freedom of speech to access p0rn.
This absolutist precedent threw out the proverbial baby with the bathwater, in overturning as protected free speech Congress’ Constitutional criminalization of “Coercion and enticement of a minor” for prostitution or sex, in Section 508 of the 1996-passed CDA.
The unintended consequences of this singular Supreme Court precedent and outdated 1997 fact-basis on autopilot, de facto has ignored how much the Internet has changed since 1997, and how it’s Wild West policy has disrupted Constitutional rule-of-law and rights since 1997.
It also has left minors unprotected from sexual predation; confused the constitutional line between protected free speech and unprotected illegal conduct online; and denied others’ Constitutional right to access justice.
This outdated, absolutist precedent for 25 years has myopically misclassified the Internet as only a communications network and speech platform, ignoring the practical reality that it is also an all-purpose technology and hence a comprehensive conduit for commercial and criminal conduct with policy that condones illegal conduct.
Before this precedent, America’s legal system routinely considered some speech not protected from government restrictions, i.e., “incitement, defamation, fraud, obscenity, child porn0graphy, fighting words, and threats.” Perversely today online, “incitement, defamation, fraud, obscenity, child porn0graphy, fighting words, and threats,” are routine and tolerated online, which is corrupting and criminalizing America’s culture.
Simply, it helps enable Internet technology firms to govern people and conduct commerce with impunity.
Executive Branch – Corporate self-regulation
3. EXECUTIVE BRANCH July 1, 1997, Presidential Directive Framework for Global Electronic Commerce: “The private sector should lead. …governments should encourage industry self-regulation.”
It is a universal extreme double standard of government authority and accountability offline but not online.
This corporate self-regulation policy’s practical effect for 25 years on autopilot has been to create an absolutist corporatocracy where Internet technology firms by default can govern people and conduct commerce with impunity via one-sided, terms-of-service, end-user licensing agreements, privacy policies, and accountability-arbitrage-driven, business models.
Corporate self-regulation policy causes corruption of commerce and crony capitalism by permanently prioritizing profit over people i.e., love of money over love your neighbor.
